embed.cam User Agreement (public offer)
Reference translation. The binding text is the Russian version at /terms; in case of any discrepancy the Russian text prevails.
1. General
1.1. This document is a public offer (Art. 437(2) of the Civil Code of the Russian Federation, "CC RF") made by individual entrepreneur Andrei Androsov (Андросов Андрей Евгеньевич) (ОГРНИП 314392609200172, ИНН 392201476857, correspondence address 236016, Калининградская обл., г. Калининград, ул. Клиническая, д. 19А, кв. 119; the "Operator"), and contains all material terms of the agreement on access to the embed.cam service.
1.2. The agreement is concluded by acceptance of this offer (Art. 438(3) CC RF). Acceptance consists of ticking the consent box in the registration form and completing account registration. From that moment the agreement is deemed concluded in writing as a contract of adhesion (Art. 428 CC RF).
1.3. The Operator records and stores the version of this Agreement the User accepted and the date of acceptance. Those records are evidence of the terms agreed.
1.4. Before accepting, the User must read this Agreement together with the Privacy Policy, the Acceptable Use Policy and the Cookie Policy. Those documents form an integral part of this Agreement.
1.5. The Operator may amend this Agreement. A new version is published at the address above with its effective date, which shall be no earlier than 14 calendar days after publication. Registered Users are notified at the account email address. A User who disagrees may stop using the Service and terminate the agreement before the new version takes effect (cl. 13.2). Continued use after that date constitutes agreement.
1.6. Legal status of the Operator. The Operator is not a telecommunications operator and provides no telecommunications services (Arts. 2, 29 of Federal Law No. 126-FZ of 07.07.2003 "On Communications"): the Operator has no communications network, owns no communications facilities or lines, rents its computing capacity, and data travels over third-party networks operated by licensed telecommunications operators. The Operator is likewise not a hosting provider (Art. 2(18), Art. 10.2-1 of Federal Law No. 149-FZ of 27.07.2006), not an organiser of information dissemination (Art. 10.1 of the same law), not an audiovisual service owner (Art. 10.5), not a social network (Art. 10.6) and not a broadcaster (Art. 31 of Law of the Russian Federation No. 2124-1 of 27.12.1991). The Operator's activity is not among those requiring a licence (Art. 12 of Federal Law No. 99-FZ of 04.05.2011).
1.7. A full explanation of cl. 1.6 with citations is published at https://embed.cam/legal/status. That document is informational and does not modify this Agreement.
2. Definitions
2.1. Service (Software) — the computer program and its functionality, available at https://embed.cam and its subdomains, which connects to the User's Source, obtains the video signal once, and displays it to Viewers. The exclusive right to the Software belongs to the Operator (cl. 9.1).
2.2. User — a legally capable natural person aged 18 or over, an individual entrepreneur, or a legal entity that has accepted this offer.
2.3. Source — the User's camera, other device or server providing a video stream over RTSP, or a stream the User publishes into the Service over RTMP/SRT.
2.4. Camera — a record in the Service describing one Source and its settings.
2.5. Viewing link ("public link", "embed link") — a unique URL granting access to view a Camera's stream without registration or authentication. Knowledge of the link is sufficient for access.
2.6. Viewer — any person who opens a Viewing link.
2.7. Dashboard — the authenticated part of the Service.
2.8. Quotas — the published quantitative limits of free use (number of Cameras, links, traffic volume and others).
3. Subject matter
3.1. The Operator grants the User a simple (non-exclusive) licence to use the Software for its intended purpose (Arts. 1235, 1286 of the Civil Code of the Russian Federation): create Cameras, obtain a video signal from a Source, display it to Viewers, create and revoke Viewing links, embed the player on third-party sites, and view statistics. The licence is revocable, non-transferable, runs for the term of the contract and is worldwide in territory.
3.1.1. This contract is concluded by the simplified procedure and is a contract of adhesion (Art. 1286(5), Art. 428 of the Civil Code): the User consents by performing the actions in cl. 1.2 and beginning to use the Software.
3.1.2. The subject matter of the contract is the grant of a right to use the Software. The contract is not a telecommunications services contract, a contract for the provision of computing capacity (hosting), a storage contract or a security contract (cl. 1.6, cl. 10.2).
3.2. During the period the Operator designates as free, the licence is granted free of charge within the Quotas, consistent with Art. 1286(5) of the Civil Code. Being free does not change either party's obligations under this Agreement.
3.3. The Operator may introduce paid plans. A fee under a paid plan is licence remuneration for the grant of a right to use the Software in the corresponding scope (number of Cameras, Viewing links, other Quotas); it is not a charge for data transmission, traffic volume or the provision of computing capacity. In that case the Operator notifies the User at least 14 calendar days before paid terms take effect; until then use remains free, and a User who declines the paid terms simply loses access with no payment obligation. Nothing in this Agreement creates a monetary obligation for the User before their separate agreement to a paid plan.
3.4. The Service does not record, archive or store video. The technical exceptions are disclosed in cl. 8.4 and in the Privacy Policy.
4. Registration and account
4.1. Use of the Service requires registration with an email address and a password, or sign-in through a supported external identity provider (Yandex ID, VK ID).
4.2. The User must provide a valid email address under their control and confirm it via the link in the message sent to it. Until the address is confirmed, adding Cameras is unavailable.
4.3. The User is responsible for keeping their password and, where enabled, their second authentication factor confidential. All actions performed in the Dashboard are deemed performed by the User unless the User proves otherwise.
4.4. The User must notify the Operator immediately of any unauthorised access to the account at support@embed.cam.
4.5. The Operator provides the ability to end all active sessions ("sign out everywhere") and recommends enabling two-factor authentication.
5. The User's warranties and obligations regarding stream content
5.1. The User warrants that, for each Source, they:
- 5.1.1. own the Source or are lawfully entitled to dispose of the video stream obtained from it;
- 5.1.2. are lawfully entitled to film the relevant territory or premises;
- 5.1.3. hold all consents and legal grounds required to publish and further use the images of individuals appearing in frame (Art. 152.1 CC RF), or the filming falls within a statutory exception where such consent is not required;
- 5.1.4. do not infringe privacy of personal life (Art. 152.2 CC RF, Art. 137 of the Criminal Code of the Russian Federation) and do not use the Service for covert surveillance;
- 5.1.5. comply with personal-data legislation in respect of persons appearing in frame and of persons to whom they grant viewing access.
5.2. The User understands and accepts that a Viewing link grants access to anyone who knows it, with no authentication. The decision to create such a link, to distribute it and when to revoke it is the User's alone.
5.3. The User shall comply with the Acceptable Use Policy and shall immediately stop a stream or revoke a Viewing link upon the Operator's reasoned request, or upon receiving a substantiated third-party complaint.
5.4. The User is liable to third parties and to public authorities for the content of the stream and the lawfulness of the filming. The Operator does not determine what a Camera films and does not pre-screen (moderate) the stream.
5.5. The User undertakes not to use the Service to establish the identity of people appearing on camera: not to apply face-recognition or other biometric identification technology to the images obtained, not to build biometric templates, and not to match images against databases for identification purposes. The Service contains no such technology (cl. 3.2 of the Privacy Policy), and the data processed in it is not biometric personal data within the meaning of Art. 11(1) of Federal Law No. 152-FZ of 27.07.2006. A breach of this clause is a gross breach (cl. 7.1).
6. The Operator's rights and obligations
6.1. The Operator shall provide access to the Service in accordance with its intended purpose and take reasonable measures to keep it operational.
6.2. The Operator may:
- 6.2.1. change the Service's functionality and introduce, change or withdraw Quotas (the User retaining the right to terminate);
- 6.2.2. suspend access to a Camera, revoke a Viewing link or suspend an account upon breach of cl. 5 or of the Acceptable Use Policy, upon a substantiated complaint or a competent authority's demand, or upon a threat to the security or stability of the Service;
- 6.2.3. carry out scheduled and unscheduled maintenance, giving advance notice of scheduled work where possible;
- 6.2.4. impose technical limits on request rates and resource consumption;
- 6.2.5. access the User's account data in support mode ("act as tenant") — solely to handle a request or resolve an incident. Every such action is written to an immutable log and confers no right to use the User's data for any other purpose.
6.2.6. The Operator does not and is not obliged to pre-screen (moderate) the video signal and does not control the content of streams. The Operator does not initiate the transmission of the video signal and does not determine its recipients — the User does (cl. 5.2, 9.5). No duty of blanket preventive inspection of content is imposed by law.
6.3. The Operator does not warrant uninterrupted or error-free operation, preservation of settings against the User's own actions, or availability of the Source, whose operation and connectivity are the User's responsibility. No service level agreement (SLA) is provided as of this version.
7. Suspension and blocking
7.1. On detecting a breach the Operator will, where possible, first notify the User with a description and a period to cure. For a gross breach — in particular filming that constitutes a criminal offence; distribution of prohibited material; actions threatening the Service or other Users' data; a competent authority's demand — access may be suspended immediately and without prior notice, with the User informed afterwards.
7.2. The User may appeal a suspension by sending a reasoned objection to support@embed.cam. The Operator will consider it within 10 business days.
8. Personal data and allocation of roles
8.1. The User's personal data (email address, authentication data, service records) is processed by the Operator as data controller/operator for the purposes and on the grounds set out in the Privacy Policy.
8.2. In respect of the video stream, the images of persons appearing in frame, and the names and email addresses of recipients the User adds for restricted-link access, the User is the personal data operator and the Operator processes such data on the User's instruction (Art. 6(3) of Federal Law No. 152-FZ of 27.07.2006 "On Personal Data").
8.3. The User hereby instructs the Operator to process the data referred to in cl. 8.2 on the following terms:
- 8.3.1. purpose — operation of the Service: connecting to the Source, relaying the stream to Viewers, generating the preview still, and granting access to restricted-link recipients;
- 8.3.2. permitted actions — collection, recording (to the extent of cl. 8.4), storage, use, transfer to Viewers according to the User's settings, blocking, deletion, destruction;
- 8.3.3. the Operator does not process this data for its own purposes, does not disclose it to third parties absent the User's instruction or a legal requirement, and does not use it for model training, profiling or advertising;
- 8.3.4. the Operator shall maintain confidentiality and apply the measures required by Art. 19 of Law No. 152-FZ, in particular: encryption of Source credentials at rest, isolation between Users, transport security (TLS), the ability to revoke all sessions, and request-rate limiting;
- 8.3.5. the Operator ceases processing and destroys the data on the User's instruction, on deletion of the Camera, or on termination of the agreement (cl. 13.4);
- 8.3.6. the User remains liable to the data subjects concerned; the Operator is liable to the User.
8.4. Technical specifics the User accepts: (a) the Service stores one still image (frame) per Camera for preview purposes, overwritten on refresh and deleted with the Camera; (b) during television casting (HLS/Chromecast) stream fragments are held temporarily in the media server's cache for the duration of the session. The Service performs no other retention of video.
9. Intellectual property
9.1. Exclusive rights to the Service, its source code, interfaces, design and trade mark belong to the Operator or are used by it on a lawful basis. The User is granted a non-exclusive, revocable, non-transferable licence to use the Service for its intended purpose for the term of the agreement.
9.2. Rights to the User's video stream and other materials remain with the User. The User grants the Operator the right to perform the technical actions strictly necessary to provide the Service (obtaining the stream, relaying it to Viewers, generating the preview still).
9.3. The User shall not: copy or modify the Service's code except as expressly permitted by law or by the licences of the open-source components used; circumvent technical restrictions or authentication; or use the Service to build a competing product by automated data extraction.
9.4. Information about the open-source components used and their licences is available in the Service, including at https://embed.cam/player/NOTICE and https://embed.cam/player/COPYING.LGPLv2.1.
9.5. The Operator is an information intermediary in respect of material transmitted by the User, within the meaning of Art. 1253.1 of the Civil Code: the Operator does not initiate the transmission and does not determine the recipient of the material; does not modify the material, except for modifications made solely to enable the technological process of transmission (format conversion, bitrate adaptation); and neither knows nor ought to know that the use of protected subject matter is unlawful.
9.6. Upon receiving a rightsholder's statement meeting the requirements of Art. 15.7(2) of Federal Law No. 149-FZ of 27.07.2006, the Operator takes the necessary and sufficient measures to stop the infringement within 24 hours. How to submit and how such statements are handled is set out in section 5 of the Acceptable Use Policy. Statements go to the address in section 15.
10. Liability
10.1. The Service is provided "as is". The Operator is not liable for: unavailability or quality of the Source and the User's connectivity; the acts of Viewers who obtained a Viewing link; the content of a stream; or losses arising because the User relied on the Service as a means of guarding, security or evidence capture.
10.2. The Service is not a security system, an alarm, a means of capturing evidence or a safety system, and must not be used as the sole means of protecting property, life or health. The Operator provides no security services within the meaning of Art. 3 of Law of the Russian Federation No. 2487-1 of 11.03.1992: it guards no premises, designs and maintains no technical security equipment, takes no response measures to alarm signals, and runs no monitoring station.
10.3. The Operator is not liable for lost profit, indirect losses or reputational harm. While the Service is provided free of charge, the Operator's aggregate liability is limited to 500 (five hundred) roubles; after paid plans are introduced, to the amount actually paid by the User for the 3 (three) months preceding the event.
10.4. The limitations in cl. 10.3 apply to the extent permitted by the law of the Russian Federation. Where the User is a consumer (using the Service for personal, family or household needs unrelated to business activity), this section does not limit their rights under Law of the Russian Federation No. 2300-1 of 07.02.1992 "On Protection of Consumer Rights".
10.5. The User shall indemnify the Operator for documented losses arising from the User's breach of cl. 5, including amounts recovered from the Operator by third parties or public authorities in connection with the content of the User's stream.
10.6. Neither party is liable in circumstances of force majeure, nor where the Service is unavailable due to the acts of third parties for whom the parties are not responsible (including the hosting provider, telecommunications operators and identity providers) or due to decisions of competent authorities.
11. Notices
11.1. The Operator's notices are sent to the account email address and/or published in the Service. A notice is deemed received on the next business day after dispatch.
11.2. All of the User's notices, reports of abuse, third-party complaints and personal-data requests go to the single address support@embed.cam.
12. Complaints and disputes
12.1. Before going to court, a party shall send the other party a written claim. The response period is 30 calendar days from receipt.
12.2. Disputes with Users who are individual entrepreneurs or legal entities shall be heard by the court at the Operator's place of business.
12.3. Disputes with consumer Users are governed by Russian consumer-protection law; this Agreement does not limit a consumer's statutory right to choose the forum.
12.4. Governing law: the law of the Russian Federation.
13. Term and termination
13.1. The agreement is concluded for an indefinite term and remains in force until terminated.
13.2. The User may withdraw at any time by deleting the account themselves in its settings or by sending an account deletion request to support@embed.cam. On request, the Operator deletes the account and associated data within 30 calendar days of receipt, except data it is required by law to retain.
13.3. The Operator may terminate unilaterally: on the User's gross breach of this Agreement or the Acceptable Use Policy, with notice; where an account has been inactive for more than 12 months, with at least 30 days' prior notice; or on discontinuation of the Service, with at least 30 days' notice.
13.4. On termination, Cameras, Viewing links and preview stills are deleted. Anonymised aggregate metrics (view and traffic counters) may be retained, as they do not identify the User.
14. Miscellaneous
14.1. Invalidity of any provision does not affect the validity of the Agreement as a whole.
14.2. The User may not assign rights or obligations under the agreement without the Operator's written consent. The Operator may assign them on reorganisation or transfer of the business, with notice to the User.
14.3. This Agreement is drawn up in Russian. Translations are provided for convenience and have no legal force; in case of discrepancy the Russian text applies.
